1. Acceptance of Terms
By accessing or using the Senior Support Resources platform (the "Service"), available at seniorsupportresources.com and related domains, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Frankventure LLC, a Texas limited liability company ("Frankventure," "we," "us," or "our"), the owner and operator of Senior Support Resources.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of another person (such as a care recipient, parent, or family member), you represent and warrant that you have the legal authority to act on that person's behalf, whether through power of attorney, legal guardianship, conservatorship, healthcare proxy, or the informed consent of the individual.
2. Description of Service
Senior Support Resources is a care coordination and information platform designed for families managing the care of senior loved ones, and for seniors self-managing their own affairs. The Service provides tools for organizing care-related information, coordinating among family members, discovering local resources, tracking medications and appointments, and accessing personalized informational guidance.
Important: Senior Support Resources is NOT a healthcare provider, medical device, clinical decision support system, or covered entity under the Health Insurance Portability and Accountability Act (HIPAA). The Service does not provide medical advice, medical diagnoses, treatment recommendations, legal advice, financial advice, or insurance advice of any kind.
All guidance, content, and information provided through the Service, including content generated by intelligent technology, is informational and observational in nature. It is not prescriptive, directive, or a substitute for the judgment of qualified professionals. Automatically generated content is produced by third-party language models and is not reviewed, verified, or approved by healthcare professionals, attorneys, financial advisors, or any licensed practitioners before being displayed to you.
You should always consult with qualified professionals, including physicians, attorneys, licensed social workers, and financial advisors, before making decisions about medical care, legal matters, financial planning, insurance coverage, or any other area where professional expertise is warranted.
3. User Accounts and Data
To use the Service, you must create an account. You are responsible for:
- Maintaining the security and confidentiality of your login credentials. You may not share your account credentials with any other person.
- All activity that occurs under your account, whether or not you authorized it.
- Ensuring that the information you enter into the Service is accurate, current, and complete, and updating it as circumstances change.
- Notifying us promptly at support@seniorsupportresources.com if you become aware of any unauthorized access to or use of your account.
The Service is organized around "Care Circles," which are groups of users coordinating care for a specific individual. All members of a Care Circle can view information shared within that circle, including care notes, documents, medications, appointments, visit logs, and other care-related data. This data sharing among circle members is a core feature of the Service, not a side effect.
If you create a Care Circle or invite others to join one, you are responsible for ensuring that every person you invite should have access to the care recipient's information. Removing a member from a Care Circle revokes their access going forward but does not retroactively delete information they may have already viewed, downloaded, or exported.
If you upload health-related information about a care recipient, you represent and warrant that you have the legal authority or informed consent to share that information, whether through power of attorney, healthcare proxy, guardianship, or the care recipient's direct permission.
4. Health Information Disclaimer
The Service allows you to store health-related information that you provide, including medications, conditions, appointments, vital signs, and care observations. This information is NOT a medical record and does not replace medical records maintained by your healthcare providers.
Drug interaction warnings displayed in the Service are informational only. They are derived from publicly available databases, including the National Library of Medicine's RxNorm system, the OpenFDA adverse event and label databases, and the DailyMed drug label repository. These warnings may be incomplete, may not reflect the latest clinical evidence, and do not account for your specific medical history, genetics, or other medications not entered into the Service. Always consult your pharmacist or prescribing physician regarding potential drug interactions.
Medication reminders, appointment reminders, and wellness check-ins are convenience features only. They are not clinical systems. They may fail due to technical issues, carrier delays, or service outages. Do not rely on the Service as your sole method of tracking medication schedules or appointment times.
Automatically generated guidance, including care scripts, condition summaries, appointment preparation notes, and medical summaries, uses hedging and observational language by design. This content should not be relied upon as medical advice, and it should not be presented to healthcare providers as a substitute for your own medical history or clinical records.
Pattern detection, health alerts, and proactive suggestions generated by the Service are observational, not diagnostic. They may identify trends in data you have entered, but they are not clinical assessments and should not be treated as such.
In a medical emergency, call 911 immediately. Do not rely on the Service for emergency communication or response.
5. Third-Party Services and APIs
The Service integrates with a number of third-party services and public data sources to provide its functionality. These include, but are not limited to:
- Supabase for database hosting and authentication
- Anthropic Claude for intelligent content generation and analysis
- Twilio for SMS-based reminders and wellness check-ins
- Resend for email notifications, invitations, and reports
- Stripe for payment processing and subscription billing
- Vercel for application hosting and serverless functions
- Government APIs, including the Centers for Medicare and Medicaid Services (CMS) for facility ratings, provider data, and coverage information; the National Library of Medicine (NLM) for drug data and clinical terminology; the National Oceanic and Atmospheric Administration (NOAA) for weather alerts; and the National Provider Identifier (NPI) registry for provider lookup
Data obtained from government APIs, including Medicare coverage determinations, nursing home ratings, hospital quality scores, drug labels, and provider information, comes from official public sources but may not be current. Government agencies update their data on their own schedules, and there may be delays between when conditions change and when public data reflects those changes.
Drug pricing information, where available through services such as GoodRx, is approximate and may not reflect the price you actually pay at any given pharmacy. Prices vary by location, pharmacy, insurance plan, and other factors.
CMS facility ratings (for nursing homes, hospitals, and home health agencies) are derived from public inspection, survey, and quality data. These ratings may lag behind current conditions at any facility. A high rating does not guarantee quality of care, and a low rating does not necessarily reflect current conditions.
Frankventure LLC is not responsible for the accuracy, completeness, timeliness, or reliability of any data provided by third-party services or government APIs. We do not control these data sources and make no representations or warranties regarding their content.
5b. Data Storage and Security
Your data is stored in cloud infrastructure provided by Supabase (hosted on Amazon Web Services, us-east-1 region). All data is encrypted in transit using TLS 1.3 and encrypted at rest using AES-256 encryption. Database access is governed by row-level security policies that restrict data visibility to authorized users within your Care Circle.
Certain data may be stored locally in your browser (such as journal drafts, allergy notes, accessibility preferences, and conversation history) and is not transmitted to our servers unless you explicitly choose to share it.
Emergency share links generated through the Service (for use in emergency room settings or with healthcare providers) are temporary and expire automatically after 24 hours. After expiration, the link becomes inaccessible. You may generate a new link at any time from your account.
We do not sell your data. We do not share your personal data or health-related information with advertisers, data brokers, or any third party for marketing purposes. Your data is used solely to provide and improve the Service.
Breach notification. In the event of a data breach that affects your personal information, we will notify affected users by email within 72 hours of confirming the breach, consistent with applicable law. We will describe the nature of the breach, the data involved, and the steps we are taking to address it.
5c. Subscription and Billing
The Service may offer free and paid subscription tiers. Paid features, when available, are billed on a monthly or annual basis through Stripe. We do not store your payment card information; all payment processing is handled by Stripe, Inc., subject to Stripe's Terms of Service.
- 30-day satisfaction guarantee. If you are not satisfied with a paid subscription, you may request a full refund within 30 days of your initial purchase by contacting support@seniorsupportresources.com. After 30 days, subscription fees are non-refundable, though you may cancel at any time to prevent future charges.
- We reserve the right to modify subscription pricing upon 30 days' written notice to active subscribers. Continued use after the effective date of a price change constitutes acceptance.
- If your payment fails, we will attempt to notify you before suspending access to paid features. Free features remain accessible regardless of payment status.
5d. Push Notifications
The Service supports browser-based push notifications for medication reminders, appointment alerts, task assignments, and other care-related updates. Push notifications are strictly opt-in. You must explicitly grant permission through your browser to receive them, and you may revoke that permission at any time through your browser settings or the Service's notification preferences.
Push notifications, like SMS reminders, are convenience features. They may fail due to browser settings, device conditions, or network issues. Do not rely on push notifications as your sole method of tracking time-sensitive care activities.
6. Insurance and Financial Information
The Service may display information related to insurance coverage, Medicare benefits, veterans' benefits, and financial planning for care. All such information is provided for general informational purposes only and does not constitute financial advice, insurance advice, or tax advice.
- Insurance coverage information presented in the Service is based on publicly available plan details and general eligibility guidelines. Actual coverage determinations are made solely by insurance providers, Medicare, Medicaid, or the applicable benefits administrator, not by Frankventure LLC.
- Benefits screening tools use general eligibility criteria to suggest programs that may be relevant to your situation. Eligibility is determined by the administering agency, and screening results do not guarantee qualification or enrollment.
- Appeal letter templates, concern letters, and similar generated documents are starting points for your own use. They are not legal documents and are not a substitute for legal counsel. You should review any such document carefully and consult an attorney before submitting it to any insurer, government agency, or healthcare provider.
- Cost estimates for care, procedures, medications, and facilities are based on averages and publicly available data. Actual costs will vary based on your location, provider, insurance plan, and individual circumstances.
- Tax-related information, including potential deductions for caregiving expenses, is general in nature. Consult a qualified tax professional for advice specific to your situation.
7. Emergency Features Disclaimer
The Service includes certain features designed to help you prepare for emergencies, including an emergency go-bag checklist, shareable emergency room information links, fall response guidance, and emergency contact management.
These features are convenience and preparation tools only. Senior Support Resources is not an emergency response system, a medical alert service, or a substitute for calling 911.
Shareable ER links are designed to give emergency room staff quick access to relevant information you have chosen to share. They are not medical records, may not be complete or current, and should not be relied upon as the sole source of patient information in an emergency setting.
Fall response guides and safety checklists are informational. They do not replace proper medical training, first aid certification, or professional emergency response.
Always call 911 in a medical emergency. Do not rely on any feature of this Service as a substitute for emergency medical services.
8. SMS Check-In Terms
If you or your care recipient opt in to SMS-based check-in services, medication reminders, or appointment reminders:
- Message frequency varies based on your configured schedule and enabled reminders.
- Standard message and data rates may apply depending on your wireless carrier and plan.
- Reply STOP to any message to cancel SMS communications at any time.
- Reply HELP for assistance, or contact support@seniorsupportresources.com.
- SMS delivery depends on your wireless carrier and network conditions. Messages may be delayed or undelivered. Frankventure LLC is not responsible for carrier failures, network outages, or delayed messages.
- SMS is not a reliable method for emergency communication. Do not rely on check-in messages as a substitute for direct contact, in-person visits, or professional emergency monitoring.
Supported carriers include most major U.S. wireless carriers. Carrier participation and message delivery are not guaranteed.
9. Intellectual Property
The Service, including its software, design, user interface, features, logos, documentation, and all associated intellectual property, is owned by Frankventure LLC and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, decompile, or create derivative works based on the Service or any part of it without our prior written permission.
You retain full ownership of all data and content you create, upload, or enter into the Service ("User Content"). We do not claim any intellectual property rights over your User Content. By using the Service, you grant Frankventure LLC a limited, non-exclusive, royalty-free license to process, store, and display your User Content solely for the purpose of providing and improving the Service. We will not sell your User Content or use it for advertising purposes.
Automatically generated content produced through the Service, including conversation scripts, care summaries, appeal letters, condition guidance, and similar outputs, may be used freely by you for personal, non-commercial purposes related to your caregiving activities. Care guide content, skill-building materials, and educational resources within the Service are for personal use only.
10. Data Export and Portability
You may export your data from the Service at any time using the built-in export features, which support full JSON export as well as CSV exports for specific data categories (medications, visit logs, health metrics, and incident logs).
Exported data may contain sensitive health-related information about you and your care recipient. Once data has been exported from the Service, you are solely responsible for its security, storage, and handling. Frankventure LLC has no control over or liability for exported data.
11. Acceptable Use
You agree not to use the Service to:
- Violate any applicable federal, state, or local law or regulation.
- Upload content that is harmful, abusive, defamatory, threatening, or otherwise objectionable.
- Monitor, manage, or coordinate care for any individual without their knowledge and consent, unless you hold legal authority to do so (such as guardianship, conservatorship, or power of attorney).
- Attempt to gain unauthorized access to any part of the Service or its systems.
- Interfere with or disrupt the Service, its servers, or its infrastructure.
- Use the Service to collect information about other users without their consent.
- Upload malicious code, viruses, or other harmful material.
- Resell, redistribute, or commercially exploit the Service without our written permission.
- Use the Service or its smart features to generate content for purposes unrelated to caregiving or senior care.
We reserve the right to suspend or terminate accounts that violate these acceptable use requirements, with or without prior notice depending on the severity of the violation.
12. Account Termination
You may delete your account at any time through your account settings or by contacting support@seniorsupportresources.com. We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service.
Upon account deletion:
- You may request an export of your data before or within 30 days of account deletion.
- Your personal data will be permanently deleted from our systems within 30 days after account deletion, except where retention is required by applicable law.
- Data you contributed to a shared Care Circle (visit logs, care notes, task completions) will persist for other circle members, as it forms part of the shared care record. Your identifying information on those contributions will be anonymized.
- If you are the primary caregiver of a Care Circle, you should transfer that role to another member before deleting your account. If you delete your account without transferring, the circle will remain accessible to other members but may have reduced administrative functionality.
13. Disclaimer of Warranties and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR RELIABILITY.
Without limiting the foregoing, Frankventure LLC makes no warranty or representation that:
- The Service will meet your requirements or expectations.
- The Service will be uninterrupted, timely, secure, or error-free.
- Any information, guidance, or content provided through the Service, including automatically generated content, drug interaction data, facility ratings, benefit eligibility information, or provider data, will be accurate, complete, current, or reliable.
- Any defects or errors in the Service will be corrected.
- The Service is suitable for any particular medical, legal, financial, insurance, or caregiving situation.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRANKVENTURE LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF FRANKVENTURE LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, FRANKVENTURE LLC SHALL NOT BE LIABLE FOR ANY DAMAGES, INJURIES, OR LOSSES ARISING FROM: (A) ANY MEDICAL, LEGAL, FINANCIAL, INSURANCE, OR OTHER DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED THROUGH THE SERVICE; (B) ANY ACTIONS OR OMISSIONS BY HEALTHCARE PROVIDERS, ATTORNEYS, FINANCIAL ADVISORS, INSURERS, OR OTHER PROFESSIONALS; (C) THE ACCURACY OR COMPLETENESS OF ANY AUTOMATICALLY GENERATED CONTENT, DRUG INTERACTION DATA, BENEFIT ELIGIBILITY INFORMATION, FACILITY RATINGS, OR PROVIDER INFORMATION; (D) MEDICATION ERRORS, MISSED APPOINTMENTS, MISSED REMINDERS, OR ADVERSE HEALTH OUTCOMES OF ANY KIND; (E) ANY THIRD-PARTY SERVICE OUTAGES, FAILURES, OR DATA INACCURACIES; OR (F) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.
Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the greater of: (i) the total amount you paid to Frankventure LLC for use of the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) one hundred dollars ($100.00 USD). As the Service is currently offered free of charge, you acknowledge that this limitation reflects the allocation of risk between the parties.
The limitations and disclaimers set forth in this section are fundamental elements of the basis of the bargain between Frankventure LLC and you. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, the limitations above apply only to the fullest extent permitted by applicable law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Frankventure LLC, its members, managers, officers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your use of or access to the Service.
- Your violation of these Terms.
- Your violation of any rights of another person or entity.
- Any User Content you upload, share, or transmit through the Service.
- Any decisions you make or actions you take (or fail to take) based on information provided through the Service.
- Your failure to obtain proper consent or legal authority before entering information about a care recipient.
- Claims brought by care recipients, their legal representatives, or their estates arising from your use of the Service in connection with their care.
This indemnification obligation will survive the termination of your account and these Terms.
15. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
15.1 Agreement to Arbitrate
You and Frankventure LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service (collectively, "Disputes") will be resolved exclusively through binding individual arbitration, rather than in court, except that either party may bring individual claims in small claims court if they qualify.
15.2 Arbitration Rules and Forum
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. If AAA is unavailable, the parties shall agree on an alternative arbitration forum. The arbitration shall be conducted by a single arbitrator. The arbitration shall take place in Tarrant County, Texas, or at another mutually agreed location, or may be conducted by telephone or videoconference if the amount in controversy is less than $25,000.
15.3 Class Action Waiver
YOU AND FRANKVENTURE LLC AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
15.4 Jury Trial Waiver
YOU AND FRANKVENTURE LLC HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. You and Frankventure LLC are instead electing that all Disputes shall be resolved by arbitration.
15.5 Opt-Out Right
You may opt out of this arbitration provision by sending written notice to support@seniorsupportresources.com within thirty (30) days of first accepting these Terms. Your notice must include your name, account identifier, and a clear statement that you wish to opt out of binding arbitration. If you opt out, disputes will be resolved in accordance with the Governing Law section below.
15.6 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
16. Changes to Terms
We may revise these Terms from time to time. For material changes, we will provide notice through the Service (such as a banner or notification), by email, or both, at least 30 days before the changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you should stop using the Service and delete your account.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions. To the extent that any dispute is not subject to arbitration under Section 15, such dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of such courts.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect. The invalidity of any provision in a particular jurisdiction shall not invalidate that provision in any other jurisdiction.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Frankventure LLC regarding your use of the Service. These Terms supersede any prior agreements, communications, or understandings between you and Frankventure LLC regarding the Service.
